However, a business should require an independent business that has its own employees to obtain a disability benefits insurance policy if the independent business is working as a subcontractor. The legal distinction between an independent contractor and employee is often times hard to ascertain. Employee benefits improve overall employee health, productivity and morale. Many contractors pay the fringe benefit portion of the prevailing wage as additional cash wages, not realizing that it’s inflating their bids and costing them more in payroll taxes. Workers who are misclassified as contractors miss out on important benefits and legal protections. Contractors can deduct unreimbursed business expenses, but a deduction is less valuable than a dollar-for-dollar reimbursement. There are other types of employee benefits that companies are not required to offer, but choose to provide to their employees. Employee benefits are non-salary compensation that can vary from company to company. Almost half the (medium and large) employers surveyed offered either a defined benefit or a defined contribution pension plan. In addition, there is an increasing use of bonuses, perks, and incentives by employers to recruit and retain employees.

Liability may also be an issue, especially if the worker does not carry their own general liability insurance or has insufficient coverage. Independent contractors generally provide their own tools and equipment. Contract employment offers a variety of benefits for both employers and independent contractors. The hiring process, training and benefits associated with hiring full time employees can cost well into the thousands of dollars. Companies needing a specialized skill set for a finite or indefinite project may not wish to take the time to train new or current employees.

One of the main benefits, next to cost savings, for hiring contract labor involves the ease of separation. Permanent employees, whether full- or part-time, have numerous rights and protections under federal and state laws. Independent contractors make their own hours, decide when to work and who to work for. A few years later, however, several changes occurred that made my independent contractor status a bit harder to justify. Group life and health programs are a fantastic addition to any business. The general rule for placing a value on a fringe benefit is to use the fair market value of the benefit given. The reporting requirements differ based on who receives the benefit.
